Purpose and Scope<\/h2>\n <p>\n This Acceptable Use Policy (“AUP”) governs access to and use of the Invela Services (“Services”) by anyone who accesses or uses the Services in any capacity, including, in the case of entities, their respective employees, contractors, and authorized users (collectively, “Users”). Access to or use of the Services constitutes acceptance of this AUP.\n <\/p>\n <\/section>\n\n <section id=\"definitions\">\n <h2>2. Definitions<\/h2>\n <p>\n <strong>“Customer”<\/strong> means a User that has entered into an agreement with Invela to access the Services. Customers are responsible for ensuring that their employees, contractors, and other authorized Users comply with this AUP. This AUP is incorporated by reference into each Customer’s agreement with Invela.\n <\/p>\n <p>\n <strong>“Credentials”<\/strong> means API keys, tokens, passwords, certificates, or other authentication means issued for access to the Services.\n <\/p>\n <p>\n <strong>“Invela Network”<\/strong> means Invela and the entities it has authorized to participate in its data network, collectively.\n <\/p>\n <p>\n <strong>“Invela Platform”<\/strong> means the integrated offering of the Services and related APIs.\n <\/p>\n <\/section>\n\n <section id=\"prohibited\">\n <h2>3. Prohibited Uses<\/h2>\n <p>All Users are prohibited from:<\/p>\n <ul>\n <li>Accessing, processing, or sharing any data obtained through the Services beyond the scope of the authorization under which access was granted, or using it for advertising, profiling, or any undisclosed secondary purpose;<\/li>\n <li>Selling or transferring any data obtained through the Services to any third party without Invela’s prior written consent and proper authorization;<\/li>\n <li>Attempting to circumvent any security mechanism of the Services; sharing or mishandling Credentials; or introducing malicious code into the Services or connected systems;<\/li>\n <li>Scraping data from the Services by automated means outside the permitted API, or submitting traffic volumes that unreasonably burden the Invela Network;<\/li>\n <li>Reverse engineering any component of the Services or the Invela Platform;<\/li>\n <li>Using the Services to facilitate fraud, money laundering, sanctions evasion, or any violation of applicable law including, but not limited to, GLBA, FCRA, and the Consumer Financial Protection Act; and<\/li>\n <li>Impersonating Invela, another User, or any other person or entity.<\/li>\n <\/ul>\n <\/section>\n\n <section id=\"enforcement\">\n <h2>4. Enforcement<\/h2>\n <p>\n Violations of this AUP may result in one or more of the following: suspension of Credentials or Invela Platform access pending investigation; termination of the Customer’s agreements with Invela; notification of affected parties or regulators; referral to the CFPB, federal banking regulators, or other authorities; or pursuit of civil remedies including injunctive relief and damages. Nothing in this AUP limits Invela’s rights under applicable law or any applicable agreement.\n <\/p>\n <\/section>\n\n <section id=\"general\">\n <h2>5. General<\/h2>\n <p>\n Invela may update this AUP from time to time to reflect changes in the Services, the Invela Network, or applicable law. Continued use of the Services after the effective date constitutes acceptance.
